Ensuring Liquor Licence Compliance: A Guide for Liquor Licence Holders

Key Liquor Licence Requirements:
Under Regulation 37(1), every liquor licence holder must ensure that certain information is clearly displayed at their premises. This includes:
1. The name of the premises.
2. The WCP/Liquor licence number.
3. The type of liquor licence.
4. Trading hours.
When a WCLA liquor inspector or SAPS offical enters your premises, the following documents must be visible to consumers:
1. A copy of the original liquor licence and its conditions (including the approved plan).
2. A copy of the Form 21 A (Renewal Notice) issued for the applicable year.
3. A copy of the proof of payment for the renewal fees for the applicable year.
4. If a transfer took place, a copy of the transfer certificate and its conditions.
5. If the licence was moved, a copy of the removal certificate and conditions.
6. The manager's appointment must be displayed clearly.
Managerial Appointment: A Key Compliance Step
Both SAPS and the WCLA have frequently highlighted issues with businesses that fail to appoint a manager as required by Section 52 of the Western Cape Liquor Act, 2008.
To ensure compliance, here’s the process for appointing a manager:
1. Download Form 15 from the WCLA website and complete it.
2. Have your application and two additional copies stamped by SAPS.
3. Submit a report clearing the nominated manager in terms of Section 35 of the Western Cape Liquor Act.
4. The WCLA tribunal will then review the application and provide an outcome.
5. Request a training booking form from liquor enquiries at liquor.enquiries@wcla.gov.za.
6. Complete and send the form back in Word format along with a copy of the manager's identity document.
7. The training facilitator will schedule a Zoom training session for your convenience.
8. Upon completion, the WCLA will issue a training certificate.
Section 64 of the Western Cape Liquor Act: Compliance is Key
Since 2022, the WCLA has begun implementing Section 64 of the Western Cape Liquor Act, requiring non-compliant licence holders to prove that their establishment still serves the public interest when renewing their liquor licence. From July 2022 to 2023, notices were sent to licence holders indicating that their licences would not be renewed automatically due to non-compliance. Those who wished to continue trading were required to submit a renewal application with a fee of R2,180. Failure to apply would result in the licence lapsing, and a new application would be necessary. This process will continue every year, so it’s essential to remain compliant with the Act to avoid unnecessary costs and disruptions to your business.
Attend Community Meetings: Stay Informed and Engaged

WCLA inspectors also attend these gatherings to keep liquor licence holders informed of any changes or developments within the WCLA.
